These Terms of Service (the “Terms”) govern your use of regenerativeperformance.com (the “Site”), operated by Regenerative Performance, PLLC (“Regenerative Performance®,” “we,” “us,” or “our”). By using the Site, you agree to these Terms. If you do not agree, please do not use the Site.
1. Who We Are
Regenerative Performance® is a naturopathic medical practice located in Gilbert, Arizona, owned and operated by Dr. Drew Timmermans, ND, RMSK and Dr. Kaitlyn Myers, ND. We provide in-person care at our Gilbert clinic and telehealth care to residents of states where our providers are licensed. Our Site is intended to inform visitors about our services and help prospective patients schedule consultations.

2. Medical Disclaimer
The information on this Site is provided for general educational and informational purposes only. It is not medical advice and does not replace a consultation with a qualified healthcare provider. Using the Site does not create a doctor-patient relationship between you and Regenerative Performance. A doctor-patient relationship is only established after you have completed a consultation with one of our providers, signed our intake paperwork, and begun receiving care.
Nothing on the Site should be interpreted as a diagnosis, a treatment plan, or a promise of any particular outcome. If you have a medical condition or think you may have one, please consult your own physician. If you are experiencing a medical emergency, call 911 or go directly to the nearest emergency room.
3. Regenerative Medicine and Outcomes Disclaimer
Regenerative Performance specializes in orthobiologic procedures including platelet-rich plasma (PRP), bone marrow aspirate concentrate (BMAC), microfragmented adipose tissue (M-FAT), nerve hydrodissection, prolotherapy, and related therapies. These are medical procedures, and like all medical procedures, individual results vary and cannot be guaranteed.
We share outcomes data, case studies, and patient stories on the Site and our social media for educational purposes. These represent real experiences of real patients, but they are examples, not promises. Your results will depend on your specific condition, anatomy, health history, lifestyle, and other factors your provider will discuss with you during your consultation.
Many of the services offered by Regenerative Performance are not FDA-approved for the specific conditions they may be used to treat. Our providers offer these services based on clinical judgment, published research, and their experience. We will discuss the evidence, benefits, risks, and alternatives with you before you consent to any treatment.
4. Telehealth
We offer telehealth consultations to residents of states where Dr. Timmermans or Dr. Myers holds an active naturopathic medical license. If you are located in a state where neither provider is licensed, we are unable to provide telehealth care to you, though you are welcome to travel to our Gilbert clinic for in-person care.
Telehealth is not appropriate for every patient or every condition. Our providers may determine at any point during a telehealth consultation that in-person care is required. In that case, we will refer you back to a local provider or help you schedule an in-person visit at our clinic.
5. Scheduling and Payment
Booking a consultation through the Site schedules a paid appointment. It does not guarantee that you will be accepted as a candidate for any particular procedure. Candidacy is determined by your provider during and after your initial consultation.
Regenerative Performance is a cash-pay practice. We do not accept or bill insurance. All fees are due at the time of service. Quotes and price ranges posted on the Site or communicated through our staff are estimates and may change. The actual cost of your care will be confirmed in writing before any procedure is performed.
Our full Practice Policies document, including cancellation fees, payment methods, supplement ordering, lab tests, and communication expectations, will be provided at your first visit.
6. SMS and Text Messaging Program
Regenerative Performance offers a text messaging program for patients and prospective patients who opt in to receive messages from us. This section is provided to comply with CTIA guidelines, The Campaign Registry (TCR) requirements for 10DLC messaging, and the FCC’s one-to-one consent rule.
Program Description
When you opt in, Regenerative Performance may send you text messages for:
- Appointment confirmations, reminders, and rescheduling requests
- Clinical follow-up messages (for example, post-procedure check-ins)
- Replies from our office staff to questions you have sent us
- Practice updates, including office hours changes, new services, or administrative notices
- Occasional educational content and newsletter announcements (only if you separately opt in to marketing messages)
How You Opt In
You opt in by providing your mobile number on our website contact form, candidacy quiz, quote request, or scheduling widget and acknowledging the SMS consent language at submission; by giving your mobile number to our staff in person, by phone, or through our patient portal and consenting to text messaging; or by texting our business number directly.
Providing consent to receive text messages is not a condition of receiving medical care or purchasing any service from Regenerative Performance.
Message Frequency and Rates
Message frequency varies based on your interaction with our practice. Marketing messages, if you have opted in, are limited to no more than four per month. Message and data rates may apply depending on your carrier and plan.
How to Opt Out
Reply STOP to any message to stop receiving texts. You will receive a final confirmation and no further messages will be sent unless you opt back in. You may also email office@regenerativeperformance.com with “Unsubscribe SMS” in the subject line, or call (480) 508-4226. Opting out of SMS does not affect email, phone, or your patient chart.

No Sharing of SMS Consent
Regenerative Performance does not sell, rent, lease, or share your mobile phone number, SMS opt-in status, or the contents of our text messages with any third party for that third party’s marketing or promotional purposes. Your SMS consent is specific to communication between you and Regenerative Performance only. We may share your number with service providers (such as RingCentral) solely to deliver messages you have opted to receive.
Text messages are not a secure communication channel. Do not send detailed health information by text. For confidential provider communication, use our patient portal (Power2Patient) or call us directly. Our text messaging program is covered by our Privacy Policy and, for protected health information, our Notice of Privacy Practices.
7. Use of the Site
You agree to use the Site only for lawful purposes and in a way that does not infringe the rights of others. You specifically agree not to:
- Attempt to gain unauthorized access to any part of the Site, our servers, or any connected systems
- Use automated tools (scrapers, bots, crawlers) beyond what is permitted by our robots.txt file
- Interfere with the Site’s operation through denial-of-service attacks, spam, or malware
- Impersonate another person or provide false information when contacting us
- Use the Site to harass, threaten, or defame any person
- Copy, reproduce, or republish Site content beyond personal, non-commercial use without our written permission
8. Intellectual Property
All content on the Site, including text, images, videos, graphics, logos, design, trademarks, and software, is owned by Regenerative Performance, its licensors, or its providers and is protected by United States and international copyright and trademark laws.
Regenerative Performance® is a registered trademark. You may not use our name, logo, or any of our marks without our prior written consent.
You may share, link to, or quote Site content for personal, non-commercial educational purposes with proper attribution. Any other use requires our written permission.
9. Third-Party Links and Services
The Site may link to third-party websites, booking tools, or services (for example, scheduling widgets, social media pages, supplement ordering through Fullscript, or payment processors). We do not control these third-party sites and are not responsible for their content, privacy practices, or terms.
10. Testimonials and Reviews
Testimonials, case studies, and patient reviews on the Site and our social media reflect the experiences of individual patients, shared with each patient’s written permission. They are not paid endorsements and are not typical or atypical. Your outcome will be your own and may differ.
11. Limitation of Liability
To the fullest extent permitted by law, Regenerative Performance and its providers, employees, and contractors will not be liable for any indirect, incidental, consequential, special, or punitive damages arising out of your use of the Site, including loss of data, loss of profits, or business interruption.
Our total liability for any claim arising out of your use of the Site is limited to one hundred U.S. dollars ($100.00) or the amount you have paid to us for services within the past twelve months, whichever is greater.
This limitation does not apply to medical malpractice claims, personal injury claims arising from care you receive as a patient, or any other claims that cannot be limited under applicable law.
12. Indemnification
You agree to defend, indemnify, and hold harmless Regenerative Performance and its providers, employees, and contractors from any claims, damages, losses, or expenses (including reasonable attorneys’ fees) arising out of your misuse of the Site, your violation of these Terms, or your violation of any third-party rights.
13. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of Arizona, without regard to its conflict of laws principles. Any dispute arising out of these Terms or your use of the Site must be filed in a state or federal court located in Maricopa County, Arizona.
Disputes regarding medical care you receive as a patient are governed by Arizona’s medical malpractice statutes and are not subject to this section.
14. Changes to These Terms
We may update these Terms from time to time. When we do, we will update the “Last Updated” date at the top and, for material changes, provide additional notice through a prominent notice on the Site. Your continued use of the Site after the effective date of the updated Terms constitutes your acceptance of them.
15. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.
